1. Acceptance of Terms

By downloading, installing, or using the FixerUppera mobile application (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

FixerUppera is an AI-powered mobile application that helps users plan furniture transformation and upcycling projects. The App provides:

• AI-based furniture identification from photos
• Transformation idea generation
• Detailed step-by-step project plans
• Shopping lists with estimated costs
• AI-generated concept preview images (mockups)
• Plan saving, sharing, and export features

3. User Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent that you are at least 13 years old. If you are under 18, you should use the App only with the involvement of a parent or guardian.

4. User Responsibilities

When using the App, you agree to:

• Use the App only for its intended purpose of furniture transformation planning
• Only upload photos that you have the right to use
• Not upload photos containing inappropriate, illegal, or harmful content
• Not attempt to reverse-engineer, decompile, or tamper with the App
• Not use the App to infringe on the intellectual property rights of others
• Follow all applicable safety guidelines when undertaking DIY projects

5. AI-Generated Content Disclaimer

The App uses artificial intelligence to generate transformation ideas, plans, mockups, and other content. You acknowledge and agree that:

• AI content is for inspiration only. Plans, ideas, and mockups are suggestions and should not be treated as professional advice.
• Mockups are concept previews. AI-generated images show possible outcomes. Actual results will vary depending on your materials, techniques, skill level, and workmanship.
• Cost and time estimates are approximate. Actual costs and time required may differ based on local pricing, tool availability, and project complexity.
• AI may produce errors. Generated content may contain inaccuracies, impractical suggestions, or unsuitable recommendations. Always use your own judgment.
• Safety is your responsibility. Always follow proper safety precautions when using tools, chemicals, paints, and other materials. Consult professionals for structural or electrical work.

6. Intellectual Property

6.1 Our Content

The App, including its design, code, graphics, animations, and branding, is owned by FixerUppera and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our App without permission.

6.2 Your Content

You retain ownership of any photos you upload. By uploading photos, you grant us a limited, non-exclusive license to process them through our AI services solely for the purpose of providing the App’s functionality. We do not claim ownership of your photos.

6.3 AI-Generated Content

You are free to use AI-generated plans, ideas, and mockups produced by the App for your personal, non-commercial projects. We make no claim of exclusivity over AI-generated content, and the same or similar outputs may be generated for other users.

7. Subscriptions and Payments

7.1 Free Trial

New users receive a free trial with limited AI generations. The trial period and usage limits are displayed in the App. No payment is required for the free trial.

7.2 Paid Subscriptions

The App offers paid subscription tiers (“Flipper” and “Pro Flipper”) that provide increased or unlimited AI generation limits. Subscriptions are billed through Google Play on a monthly or annual basis.

7.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage and cancel subscriptions through Google Play’s subscription management settings.

7.4 Usage Limits

Each subscription tier includes specific usage limits for AI features (identifications, plans, mockups, etc.). Usage limits reset at the beginning of each billing period. Exceeding limits requires upgrading to a higher tier.

7.5 Refunds

Refund requests are handled by Google Play in accordance with their refund policies. We do not process refunds directly. If you believe you have been charged in error, please contact Google Play support or email us at hello@fixeruppera.app.

7.6 Price Changes

We reserve the right to change subscription prices. Existing subscribers will be notified of price changes in advance through Google Play. Founding member pricing, where applicable, is locked in for the duration of the subscriber’s continuous subscription.

8. Third-Party Services

The App relies on third-party AI services (OpenAI and Alibaba Cloud DashScope) and hosting infrastructure (Vercel) to function. We are not responsible for the availability, accuracy, or performance of these services. Service interruptions or changes by these providers may temporarily affect App functionality.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

• The App is provided “as is” and “as available” without warranties of any kind, express or implied.
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
• We are not liable for any damages resulting from your use of AI-generated plans, ideas, or mockups, including but not limited to property damage, personal injury, or financial loss.
• We are not liable for any damages resulting from undertaking DIY projects based on the App’s suggestions.
• Our total liability shall not exceed the amount you have paid for the App in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless FixerUppera, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate access to the App at any time, without notice, for any reason. You may stop using the App at any time by uninstalling it from your device. Sections 5, 6, 7, 9, and 10 survive termination.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles.
